Cookies
Cookies are small data or text files that websites and applications place on your local computer. Such cookies can serve different purposes: there are technical cookies (for example to remember a language setting), session cookies (temporary cookies that expire after one session) and tracking cookies (cookies that follow and record your behaviour on the internet, in order to offer you a better user experience).
The Belgian Act on electronic communication of 13 June 2005 contains a number of provisions on cookies and their use on websites. The Act transposes the European e-Privacy Directive, which means that cookie legislation can be implemented differently in other European member states.
Fitchen is established in Belgium and therefore follows Belgian cookie legislation.
Purpose and use of cookies
Fitchen wants to inform every visitor of the platform and the website as well as possible about their rights under Belgian cookie legislation, and about which cookies Fitchen uses. By using the platform and the website, the visitor agrees to the use of cookies. Cookies help Fitchen to optimise your visit to the platform and the website, to remember technical choices (a language choice, a newsletter, and so on) and to show you more relevant services and offers.
If you wish to consult the Fitchen platform or website, it is advisable to have the technical settings for cookies switched on. Without cookies switched on, Fitchen cannot guarantee a trouble free visit to the platform or the website. If you would rather not have cookies, you are free as a visitor to switch them off.

Managing cookies
Make sure cookies are enabled in your browser. To enable cookies, the following steps must be taken:
Browser: Microsoft Internet Explorer
In Internet Explorer, click ‘Internet options’ in the ‘Tools’ menu.
On the ‘Privacy’ tab, move the settings slider to ‘low’ or ‘accept all cookies’ (a setting above ‘medium’ disables cookies).
Click ‘OK’.
Browser: Mozilla Firefox
Click ‘Firefox’ in the top left corner of your browser and then click ‘Options’.
On the ‘Privacy’ tab, make sure that ‘Tell websites I do not want to be tracked’ is not ticked. Click ‘OK’.
Browser: Google Chrome
Click the three dots next to the browser bar at the top of your browser window and choose ‘Options’.
Find the ‘Privacy and security’ section and click ‘content settings’.
Click the ‘cookies’ option. Now select ‘Allow sites to save and read cookie data’.
Browser: Safari
Choose ‘Preferences’ in the task menu. (The task menu is at the top right of the Safari window and looks like a cog, or click ‘Safari’ in the extended task menu.)
Click the Privacy tab. Find the section called ‘Cookies and other website data’
Indicate that you accept cookies.
If you wish to consult the Fitchen platform or website, it is advisable to have cookies switched on. If you would rather not, however, you are free as a visitor to switch cookies off through your browser settings. This can be done in the following ways:

Close the ‘about: preferences’ page. Any changes you have made are saved automatically.

Select ‘More settings’ in the browser toolbar.
At the bottom of the page, select ‘Advanced’.
Under ‘Privacy and security’, select ‘Content settings’.
Select ‘Cookies’.
Switch off ‘Allow sites to save and read cookie data’.
Browser: Safari
Choose ‘Preferences’ in the task menu. (The task menu is at the top right of the Safari window and looks like a cog, or click ‘Safari’ in the extended task menu.)
Click the Privacy tab. Find the section called ‘Cookies and other website data’
Indicate that you do not accept cookies.

Rights of visitors
Since cookies can constitute a processing of personal data, you as a data subject have the right to the lawful and secure processing of personal data. As a data subject you can exercise the following rights:
Right to object: where there are serious and legitimate grounds, one can object to the processing of personal data.
Right of access: every data subject who proves their identity has a right of access to information about whether or not their personal data are being processed, as well as the purposes of that processing, the categories of data concerned and the categories of recipients to whom the data are disclosed.
Right to rectification: inaccurate or incomplete personal data can always be corrected, or even erased, at the request of the data subject.

Privacy
Fitchen attaches great importance to the protection of your privacy and personal data. We use your personal data solely in accordance with the Privacy Act and other relevant applicable legal provisions. Every reference in this Privacy Statement to the Privacy Act means a reference to the Act of 8 December 1992 on the protection of privacy in relation to the processing of personal data. Every reference to the Regulation is a reference to the Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
With this Privacy Statement, Fitchen wants to draw your attention to any processing operations concerning these data and to your rights. By using our platform, our website or our application, you expressly give your consent to possible processing operations by Fitchen.
This Privacy Statement may be subject to adjustments and changes in the future. It is up to you to consult this document on a regular basis. Any substantial change will always be clearly communicated on the Fitchen platform.

Which personal data are processed?
Fitchen undertakes to process only the data that are relevant and necessary for the purposes for which they were collected. The following categories of personal data may be processed by Fitchen:

For which purposes are my personal data used?
Fitchen collects personal data in order to offer you a safe, optimal and personal user experience. The collection of personal data becomes more extensive as you make more intensive use of the platform, the website or the application and our online services.
Data processing is essential to the operation of the platform, the website or the application and the associated services. Processing takes place solely for the following specified purposes:
• Giving you access to your user profile.
• Offering and improving a general and personalised service; including invoicing purposes, the offer of information, newsletters and offers that are useful or necessary for you, obtaining and processing user reviews, and providing support.
• Offering and improving the products supplied; person oriented and specific products based on the information and data provided.
• The detection of and protection against fraud, errors or criminal behaviour.
• Marketing purposes
When you visit the Fitchen platform, website or application, some data are collected for statistical purposes. Such data are necessary in order to optimise the use of our platform, our website and our application. These data are: IP address, likely place of consultation, hour and day of consultation, and which pages were visited. When you visit the Fitchen platform, website or application you agree to this collection of data intended for the statistical purposes described above.
The User always provides the personal data to Fitchen themselves and can in that way exercise a degree of control. If certain data are incomplete or apparently incorrect, Fitchen reserves the right to postpone certain expected actions temporarily or permanently.
The personal data are processed only for internal use within Fitchen. We can therefore reassure you that personal data are not sold, passed on or communicated to third parties connected to us. Fitchen has taken every possible legal and technical precaution to avoid unauthorised access and use.

What are my rights?
Guarantee of lawful and secure processing of personal data
Fitchen always processes your personal data fairly and lawfully. This entails the following guarantees:
• Personal data are processed only in accordance with the described and legitimate purposes of this Privacy Statement.
• Personal data are processed only in so far as this is adequate, relevant and not excessive.
• Personal data are kept only for as long as is necessary to achieve the described and legitimate purposes of this Privacy Statement.
The necessary technical and security measures have been taken to reduce to a minimum the risks of unlawful access to or processing of the personal data. In the event of a break in to its IT systems, Fitchen will immediately take every possible measure to limit the damage to a minimum.
Right of access, rectification and erasure of your personal data
On proof of your identity as a User, you have the right to obtain from Fitchen confirmation as to whether or not your personal data are being processed. Where Fitchen processes your data, you also have the right to obtain access to the personal data collected. If you wish to use your right of access, Fitchen will act on it within one (1) month of receiving the request. The request is made by registered post or through the contact form on the website.
Inaccurate or incomplete personal data can always be corrected. It is up to the User in the first place to correct inaccuracies and incompleteness themselves. You can exercise your right to rectification by providing a supplementary statement to Fitchen. Fitchen will act on it within one (1) month of receiving the supplementary statement.
You also have the right to have your personal data erased by us without undue delay. You can only rely on this right to be forgotten in the following cases:
Where the personal data are no longer needed for the purposes for which they were originally collected;
• Where the personal data were collected on the basis of consent obtained and no other legal ground for the processing exists;
• Where an objection is made to the processing and no overriding compelling legitimate grounds for the processing exist;
• Where the personal data were processed unlawfully;
• Where the personal data have to be erased in accordance with a legal obligation.
Fitchen assesses whether one of the aforementioned cases applies.
Right to restriction of and objection to the processing of your personal data
The User has the right to obtain a restriction of the processing of your personal data:
• For the period Fitchen needs to check the accuracy of the personal data, in the event of a dispute;
• Where the data processing is unlawful and the User requests a restriction of the processing instead of the erasure of the personal data;
• Where Fitchen no longer needs the User’s personal data for the processing purposes and the User needs the personal data in connection with a legal claim;
• For the period Fitchen needs to assess whether the grounds for erasing personal data are present.
The User also has the right at all times to object to the processing of their personal data. Fitchen will then cease the processing of your personal data, unless Fitchen can put forward compelling legitimate grounds for the processing of your personal data that outweigh the User’s right to object.
If the User wishes to exercise these rights, Fitchen will act on it within one (1) month of receiving the request. The request is made by registered post or through the contact form on the website.
Right to data portability
The User has the right to obtain the personal data provided to Fitchen in a structured, commonly used and machine readable form. In addition, the User has the right to transfer these personal data to another controller where the processing of the personal data rests solely on the consent obtained from the User.
If the User wishes to exercise this right, Fitchen will act on it within one (1) month of receiving the request. The request is made by registered post or through the contact form on the website.
Right to withdraw my consent and right to lodge a complaint
The User has the right at all times to withdraw their consent. The withdrawal of consent does not affect the lawfulness of the processing based on consent before its withdrawal. In addition, the User has the right to lodge a complaint about the processing of their personal data by Fitchen with the Belgian Commission for the Protection of Privacy.
If the User wishes to exercise this right, Fitchen will act on it within one (1) month of receiving the request. The request is made by registered post or through the contact form on the website.
